Prime Surprise Concrete Company provides concrete contracting services including, but not limited to, driveway installation, patio construction, stamped concrete, sidewalk building, garage floor concrete, decorative concrete, retaining walls, floor installation, pool decks, steps construction, slab foundation work, foundation installation, parking lot construction, footings, foundation raising, and concrete cutting.
All services are performed in Arizona and are subject to applicable state and local codes, permit requirements, and HOA regulations where applicable. The Company does not guarantee availability for any specific project dates and reserves the right to decline any project at our discretion.
All pricing provided by the Company is based on information available at the time of the estimate. Written estimates are valid for 30 days from the date issued unless otherwise stated in the estimate document.
Estimates may be subject to change if site conditions discovered during work differ materially from those observed during the initial assessment - for example, the presence of unanticipated underground utilities, structural obstructions, or soil conditions that require additional preparation. In such cases, we will notify you in writing before proceeding with additional work.
Verbal estimates are not binding. Only written, signed agreements constitute a binding commitment to a specific price for a specific scope of work.
Project start dates are estimates and may be subject to change due to weather, permitting delays, material availability, or other conditions outside our control. We will notify you promptly if a scheduled start date must change.
You may cancel a scheduled project at any time before work begins. If a deposit has been paid, cancellation policies will be outlined in your project agreement. In general, deposits may be non-refundable if materials have already been ordered or permits have been pulled on your behalf.
We reserve the right to reschedule or cancel a project due to unsafe working conditions, including extreme weather, without penalty to either party.
Payment schedules will be specified in your written project agreement. In general:
Accepted payment methods will be stated in your project agreement. Late payments may be subject to interest charges as permitted by Arizona law. The Company reserves the right to stop work on a project if a payment is not received by its due date.
Where your project requires a permit from the City of Surprise or another local authority, we will obtain the necessary permit(s) on your behalf unless otherwise agreed. Permit fees will be included in your written estimate or billed at cost.
If your property is governed by a homeowners association, it is your responsibility to confirm whether HOA approval is required before work begins. We can assist with providing documentation for HOA approval upon request, but we are not responsible for delays or rejections resulting from HOA review processes.
To the fullest extent permitted by Arizona law, the Company shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from or relating to our services or website, including but not limited to loss of use, loss of income, or property damage not directly caused by our negligence.
Our total liability for any claim arising from a specific project shall not exceed the total amount paid by you to us for that project.
We are not responsible for damage caused by underground utilities, pre-existing site conditions not disclosed prior to the start of work, or conditions that could not have been reasonably discovered during the site assessment.
We stand behind our workmanship. Any warranty on labor or materials will be stated explicitly in your written project agreement.
The website and any information provided on it are offered "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.
Concrete is a natural material and will develop hairline cracks over time as part of normal curing and settling. The presence of minor hairline cracks in finished concrete does not constitute a defect unless the crack exceeds the threshold defined in your project agreement.
If a dispute arises from our services or these terms, we ask that you contact us first and give us a reasonable opportunity to resolve the issue directly. Most concerns can be addressed through direct communication.
If a dispute cannot be resolved informally, both parties agree to attempt mediation in Surprise, AZ before initiating any formal legal proceedings. The costs of mediation will be shared equally unless a court later determines otherwise.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction where necessary to prevent irreparable harm.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms shall be brought in a court of competent jurisdiction located in Arizona.
